Stan Lee's Mutants, Monsters and
Marvels Sweepstakes
OFFICIAL RULES
NO PURCHASE NECESSARY.
VOID IN PUERTO RICO, THE PROVINCE OF QUEBEC
(CANADA) AND WHERE PROHIBITED.
1. How to Enter: Stan Lee's Mutants,
Monsters and Marvels Sweepstakes ("Sweepstakes") begins at
12:01 a.m. on May 14, 2002 and ends at 11:59 p.m. on July 31,
2002 ("Sweepstakes Period"). For purposes of this Sweepstakes,
all times refer to Eastern Time. To enter the Sweepstakes via
the Internet, access the Sweepstakes home page at
www.sonypictures.com/cthe/stanlee
("Web Site"). Then access the entry form, complete,
and thereafter
transmit it by clicking on the "Submit" button
("Online Entry").
Information required on the Online Entry form consists of your
first and last name, address, city, State/Province, ZIP/Postal
code, phone number (including area code), date of
birth, and email
address ("Entry Information"). Online Entries must be received
by 11:59 p.m. on July 31, 2002. Limit one (1) Online Entry per
person per day. Online Entries in excess of the stated limit by
the same person will be disqualified. To enter by postal mail,
legibly hand print Entry Information (email address
is optional)
on a postcard (no larger than 5"x7") or on a piece of
paper enclosed
in a business size (#10) envelope, affix proper
postage, and mail
to: Stan Lee's Mutants, Monsters and Marvels
Sweepstakes,
P.O. Box 10938, Burbank, CA 91510-0938 ("Mail
Entry"). Mail Entries
must be mailed separately, postmarked by July 31,
2002 and received
by August 5, 2002. All Entry Information must be completed in
full in order for entries to be eligible. If an entrant is from
a jurisdiction that deems him/her to be a minor,
he/she must obtain
parental/legal guardian consent prior to entering or submitting
any personally identifiable information. Proof of delivery or
receipt of entry will not be deemed by sponsor (defined below)
as proof of entry. Any attempted form of entry other
than as described
herein is void.
2. Eligibility: The Sweepstakes is only
open to legal residents of the 50 states of the United States
(and the District of Columbia) and Canada (excluding
the Province
of Quebec) who reside and are physically located
therein and who
are 18 years of age or older as of May 14, 2002. Employees of
Columbia TriStar Home Entertainment ("Sponsor"), Creative Light
Entertainment, Skycastle Entertainment, Inc.,
Sullivan Compliance
Company ("Sweepstakes Administrator"), those involved
in production,
development, implementation or handling of Sweepstakes, and any
agents acting for, or in behalf of the above
entities, and their
respective parent companies, officers, directors, subsidiaries,
affiliates, service providers, prize suppliers, advertising or
promotion agencies, or any other person or entity
associated with
Sweepstakes (collectively "Sweepstakes Entities"), and members
of the immediate families (spouses, children,
siblings, parents)
and/or persons living in the same household, and/or
persons living
in the same household as such persons, whether related or not,
are ineligible to enter Sweepstakes.
3. Prizes/Odds of Winning: One
(1) Grand Prize:
One (1) trip to be shared by GP winner and one (1)
guest ("Guest")
consisting of round-trip coach class air transportation for GP
winner and Guest from a major commercial airport near
GP winner's
residence to Los Angeles, CA; standard hotel accommodations for
2 nights (single room, double occupancy); dinner with Stan Lee
(not to exceed $150; alcohol not included)
("Dinner"); and ground
transportation to and from location of Dinner.
Approximate Retail
Value ("ARV") of the GP is: $2,000 U.S. Actual value
will depend
on point of departure and any airfare fluctuations.
Air transportation
provided only if GP winner resides more than 100
miles from destination.
Travel must be completed within one (1) year of notification
of winning. Trip subject to air travel and hotel
availability,
holiday and black-out dates, and all other prize and
travel restrictions.
Once determined, no change, extension, or substitution of trip
dates is permitted, except by Sponsor at its sole discretion.
GP winner and Guest must take air travel on same itinerary. If
GP winner is from a jurisdiction that deems him/her
to be a minor,
he/she must be accompanied by his/her parent/legal
guardian, and
such person must pay his/her own expenses unless deemed to be
the allotted Guest. If Guest is from a jurisdiction that deems
him/her to be a minor, he/she must be accompanied by
his/her parent/legal
guardian, and such person must pay his/her own expenses unless
deemed to be the GP winner. If, for any reason, any portion of
the Grand Prize is not available (e.g. scheduling conflict for
Dinner with Stan Lee), then remaining components of the GP will
constitute Sponsor's full obligation to the GP winner
and no additional
compensation will be provided. GP winner is solely responsible
for all other unspecified incidentals, including, but
not limited
to, meals, gratuities, phone calls, and any other expenses not
specifically mentioned as being included (including obtaining
all necessary and required travel documents if GP
winner is Canadian).
One (1) First Prize: One (1) DVD Player. ARV
of the First
Prize is: $229.00 U.S. Ten (10) Second Prizes: One (1)
Stan Lee's Mutants, Monsters and Marvels Sweepstakes movie on
DVD signed by Stan Lee. ARV of each Second Prize is:
$24.95 U.S.
Total ARV of all prizes is: $2,478.50 U.S. Odds of winning
depend on the total number of eligible Online and Mail Entries
received. Limit one (1) prize per person/family/household.
Winners are solely responsible for all costs, incidentals, and
any other expenses not specifically mentioned as
being included,
including but not limited to any required
installation or requested
product upgrades/options. No substitution, transfer
or cash equivalent
for prizes, except that Sponsor may substitute a prize of equal
or greater value for any reason. Prizes will be shipped to U.S.
and Canadian addresses only. If a winner is from a jurisdiction
that deems him/her to be a minor, prize may be awarded in the
name of his/her parent/legal guardian. Any depictions of prizes
are for illustrative purposes only. All federal,
state, provincial,
local or other taxes are the sole responsibility of
each winner.
4. Winner Drawing and
Notification: Potential
winners will be randomly selected in a drawing held on or about
August 14, 2002 ("Drawing Date") from among all eligible Online
and Mail Entries received. If a Canadian resident is selected
as a winner, he/she must correctly answer a time
based, mathematical
skill-testing question administered by phone/mail to
be eligible
for a prize. Potential GP winner (if from a jurisdiction that
deems him/her to be a minor, his/her parent/legal
guardian) will
be notified by phone within approximately two (2) weeks of the
Drawing Date. All other winners (if from a
jurisdiction that deems
them to be minors, their parent/legal guardian) will
be sent their
prize to the address indicated on their Online or Mail Entry.
If the potential GP winner cannot be reached after a reasonable
effort has been exerted, or any potential winner is found to be
ineligible, cannot or does not comply with these
Official Rules,
or their prize or prize notification is returned as
undeliverable,
such potential winners will be disqualified and
alternate potential
winners may be selected, at Sponsor's sole discretion.
5. General Sweepstakes
Conditions: Sweepstakes
is subject to these Official Rules and all federal,
state, provincial
and local laws (collectively "Rules and Laws"). If a winner is
from a jurisdiction that deems him/her to be a minor, prize may
be awarded in the name of his/her parent/legal
guardian. GP winner
(his/her parent/legal guardian, if he/she is from a
jurisdiction
that deems him/her to be a minor) will be required to
sign, execute,
have notarized and return an Affidavit of Eligibility, (where
legal) a Liability Release, a Publicity Release and any other
documentation that Sweepstakes Administrator and/or Sponsor may
require (collectively "Affidavit/Release") within five (5) days
of receipt by potential GP winner, or such potential GP winner
may be disqualified and an alternate potential GP winner may be
selected at Sponsor's sole discretion. Guest (Guest's
parent/legal
guardian, if he/she is from a jurisdiction that deems him/her
to be a minor) will be required to sign, execute,
have notarized
and return a Liability Release, a Publicity Release,
and any other
documentation that Sweepstakes Administrator and/or Sponsor may
require within five (5) days of receipt of these documents by
potential GP winner. By returning the completed
Affidavit/Release,
GP winner attests to the authenticity of his/her winning entry.
Once submitted, Online or Mail Entries become the sole property
of Sponsor and may not be acknowledged or returned.
Any personal
information supplied by entrants to Sponsor or its affiliates
will be subject to Sponsor's Privacy Policy. Thus, except where
prohibited by law and Sponsor's Privacy Policy: (1)
entry and/or
winner's (winner's parent/legal guardian, if winner is minor)
acceptance of prize constitutes permission for the Sweepstakes
Entities to use winner's name, address (city and
state/province),
photo, likeness, biographical information, statement and voice
for advertising/publicity purposes worldwide and in all forms
of media (including posting on web site), in
perpetuity, without
further notice to, or compensation in connection with
said Sweepstakes
or the prize awarded and (2) Sponsor has the right to modify,
use, assign and/or dispose of Online or Mail Entries however it
sees fit and for any purpose without any notice or compensation
to entrant or any third parties. Any person
attempting to defraud
or tamper with the Sweepstakes will be prosecuted and
is not eligible
for prizes. If, for any reason, Sweepstakes is not capable of
running as originally planned, Sponsor, at its sole discretion,
reserves the right to cancel, suspend or modify Sweepstakes or
any portion(s) thereof and conduct the drawing from
all salvageable
eligible Online and Mail Entries, if any. In case of a dispute
over the identity of the entrant who submitted a winning Online
Entry, the Sponsor at it sole discretion may deem the
registered
owner of the email account the winning entrant.
6. Disclaimers: Sweepstakes
Entities are
not responsible or liable for multiple entries entered by other
than human means (such as by an automated computer program or
any non-human mechanism, entity or device), or for entries that
are illegible, late, mutilated, tampered with,
forged, incomplete,
misdirected, lost, misplaced, stolen, destroyed, postage-due or
otherwise not in compliance with these Official Rules and such
entries will be disqualified. By entering Sweepstakes, entrants
agree and acknowledge to be bound by the Rules and
Laws, as well
as the decisions of Sweepstakes Administrator which are final
and binding in all respects; to waive any rights to
claim ambiguity
with the Rules and Laws, and that Sweepstakes
Entities shall have
no responsibility or liability (including, but not limited to,
liability for any property loss, damage, personal
injury or death)
in connection with: participation in this
Sweepstakes; human error;
incorrect or inaccurate transcription of Entry
Information; acceptance/possession,
use/misuse and/or defects of the prizes awarded
herein; any technical
malfunctions of the telephone network, computer online system,
computer dating mechanism, computer equipment,
software, internet
service provider; interruption or inability to access
Sweepstakes
or Web Site via the internet due to hardware or
software compatibility
problems; any damage to entrants (or any third
person's) computer
and/or its contents related to or resulting from any
part of this
Sweepstakes; any lost/delayed data transmissions,
omissions, interruptions,
defects and/or any other error or malfunctions, even if caused
by the negligence of one of the Sweepstakes Entities. Entrants
further agree to indemnify and hold harmless the
Sweepstakes Entities
from any and all liability resulting or arising from
the Sweepstakes,
to release all rights to bring any claim, action or proceeding
against the Sweepstakes Entities, and hereby acknowledge that
said Sweepstakes Entities have neither made nor are
in any manner
responsible or liable for any warranty,
representation or guarantee,
express or implied, in fact or in law, relative to any prize,
including express warranties provided exclusively by
a prize supplier
that are sent along with a prize. Entrants must also abide by
Sponsor's Privacy Policy and Terms of Service.
