1. How to Enter: "The WHALE RIDER ride to New Zealand Sweepstakes" ("Sweepstakes") begins at 9:00 a.m. PT on October 28, 2003 and ends at 5:00 p.m. PT on December 1, 2003 ("Sweepstakes Period"). For purposes of Sweepstakes, all times refer to Pacific Time ("PT"). To enter, access Sweepstakes Web site located at http://www.sonypictures.com/whalerider/whalewatching ("Web Site") and complete and thereafter submit a Sweepstakes entry form ("Entry"). Information required on the entry form consists of your Email Address, First Name, Last Name, Street Address, City, State, Zip, Phone (including area code), Gender, and Date of Birth (collectively "Entry Information"). All required Entry Information must be completed in full. Limit one (1) Entry per person/email address/day. Entries by the same person in excess of the limit stated herein will be disqualified. Entries must be received by 5:00 p.m. PT on December 1, 2003. Proof of delivery or receipt of an Entry will not be deemed by Hilltop New Media, Inc. ("Sponsor") as proof of entry. Any attempted form of entry other than as described herein is void.
   
   
2. Eligibility: Sweepstakes is only open to legal residents of the 50 states of the United States and the District of Columbia, who are physically located and residing therein, who are 21 years of age or older as of October 28, 2003, and who have a valid driver's license. Employees of Sponsor, Sony Pictures Entertainment Inc., Tourism New Zealand, National Geographic, Qantas Airways, Qantas Vacations, Newmarket Films Skycastle Entertainment, Inc., Sullivan Compliance Company ("Sweepstakes Administrator"), their advertising or promotion agencies, those involved in the production, development, implementation or handling of Sweepstakes, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, affiliates, licensees, service providers, prize suppliers, any other person or entity associated with Sweepstakes (collectively "Sweepstakes Entities") and/or members of their immediate families (spouses, children, siblings, parents) and/or persons living in the same household as such persons, whether or not related, are ineligible to enter Sweepstakes.
   
   
3. Prizes/Odds of Winning. One (1) Grand Prize: A twelve (12) day/nine (9) night trip for Grand Prize winner and one (1) guest to New Zealand. Grand Prize consists of: round trip tickets for two (2) on Qantas Airways, Economy Class from Los Angeles to Auckland, NZ and round trip tickets for two (2) on an affiliated airline from the major airport closest to the home residence of the Grand Prize winner to the Los Angeles gateway (economy class) (air transportation to Los Angeles provided only if Grand Prize winner resides more than 100 miles from Los Angeles, CA); two (2) nights accommodation (single standard room, double occupancy) for Grand Prize winner and one (1) guest at the Crowne Plaza Hotel, Auckland; seven (7) nights Flag Inn's first class Motor Inn accommodation vouchers for Grand Prize winner and one (1) guest in New Zealand; eight (8) days rental car use in New Zealand (standard, economy, manual drive auto); a voucher for Grand Prize winner and one (1) guest to complete a Great Sights Discover Auckland 1/2 Day Sightseeing Tour (basic tour plan); a voucher for Grand Prize winner and one (1) guest for a 2 1/2 to 3 1/2 hour Whale Watch Kaikoura excursion (basic excursion plan as noted on www.whalewatch.co/nz/); and one (1) copy of the movie Whale Rider on DVD. The approximate retail value ("ARV") of this prize is $4,863.25 (specific value depends on departure city and dates of travel). Rental car portion of Grand Prize is subject to rental agency age restrictions, required credit card imprint and/or cash deposit and insurance documentation provided at car rental counter, as well as agency terms and conditions of rental. If Grand Prize winner or his/her travel guest does not present a valid driver's license and any other required documentation for the rental car, this portion of the Grand Prize will be forfeited and no additional prize or compensation will be substituted. Grand Prize winner is responsible for all insurance requirements and is fully responsible/liable for any damage, loss or misuse of rental car). All travel is subject to the following restrictions: All meals, gratuities, additional ground transfers, excursions, insurance, passport and/or Visa fees, incidentals, departure and airport taxes and customs/agriculture fees and any other expenses not specified herein are the sole responsibility of the Grand Prize winner and his or her guest. All travel arrangements are to be administered by Qantas Vacations on behalf of Tourism New Zealand and Qantas Airways with specific lodging/car and travel accommodations to be determined and offered by "Whale Rider New Zealand" Promotion Partners. The rental car prize includes eight (8) days use of a Maui medium automatic rental car and Car hire includes unlimited kilometres and Standard Excess Reduction insurance with an excess of NZD1,000. The accommodation prize includes seven (7) nights using Flag Inn's first class Motor Inn accommodation vouchers. Flag Inn's first class Motor Inn accommodation vouchers covers 100 properties throughout New Zealand. Travel will not be eligible to earn any frequent flyer points or miles. "Whale Rider New Zealand " air travel must be pre-scheduled by contacting Qantas Vacations at least six (6) weeks before requested departure date and be completed by 12/05/04 and is subject to carriers', hotels' and auto rental company holiday and other blackout dates (including but not limited to between 12/6/03 and 1/15/04) and other carrier, hotel and auto rental company restrictions. Grand Prize winner and his/her travel guest must travel together on the same itinerary. Grand Prize winner and his or her travel companion are responsible for obtaining all necessary travel documentation including Passports and Visas and will be required to provide valid government issued photographic ID at time of travel. No changes will be made to travel details once any portion of travel arrangements have been made. Sponsors are not responsible for changes in schedule of any element of the Grand Prize. Prize conditions may be added or modified by companies providing those portions of the Grand Prize. For sightseeing tour and Kaikoura excursion, Grand Prize winner must travel during the schedule for those services which is subject to change (due to availability and other exigencies). If the sightseeing tour and/or Kaikoura excursion is not available during time of Grand Prize winner's trip for whatever reason (e.g. weather conditions, seat availability), sightseeing tour and/or Kaikoura excursion will be forfeited and Grand Prize winner will receive Grand Prize without respective sightseeing tour and/or Kaikoura excursion and no compensation will be awarded in lieu thereof. Grand Prize winner will have one (1) year from date of notification of winning to take trip. If trip guest is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, who must pay all of his/her own expenses unless that person is deemed to be a Grand Prize winner. Five (5) First Prizes. Each First Prize consists of one (1) copy of the movie Whale Rider on DVD. ARV of each First Prize is $26.95. The Total ARV of all prizes is $4,998.00. Limit one (1) prize per person/family/household. Odds of winning a prize depends on the total number of eligible Entries received. No substitution, transfer or cash equivalent for a prize (or prize component), except that Sponsor, at its sole discretion, may substitute a prize of equal value due to prize unavailability for any reason. Prizes will be shipped within the 50 states of the U.S. and D.C. only. Any depictions of prizes are for illustrative purposes only. All federal, state, or other taxes are sole responsibility of each winner.
   
   
4. Drawing and Notification of Winners: Potential winners will be randomly selected from all eligible Entries received in a drawing held on or about December 11, 2003 ("Drawing Date") by Sweepstakes Administrator, an independent judging organization. Potential Grand Prize winner will be notified by phone within one (1) week of the Drawing Date. Each potential First Prize winner will be notified by mail, phone, and/or email within six (6) weeks of the Drawing Date. If a potential winner cannot be reached after a reasonable effort has been exerted, he/she is found to be ineligible, he/she cannot or does not comply with these Official Rules, or if a prize or prize notification is returned as undeliverable, such potential winner will be disqualified and an alternate potential winner will be selected at Sponsor's sole discretion.
   
   
5. General Conditions: Sweepstakes is subject to these Official Rules and all federal, state and local laws and regulations (collectively "Rules and Laws"). Potential Grand Prize winner will be required to execute, have notarized, and return an Affidavit of Eligibility, a Liability Release, a Publicity Release (where legal), and any other documentation that Sweepstakes Administrator and/or Sponsor may require (collectively "Affidavit/Release"), within five (5) days after receipt or such potential Grand Prize winner may be disqualified and an alternate potential Grand Prize winner will be selected. By returning the completed Affidavit/Releases, such potential Grand Prize winner attests to the authenticity of his/her Entry. Guest (or, his/her parent/legal guardian, if a resident of a jurisdiction that deems him/her to be a minor) of Grand Prize winner will be required to execute, have notarized, and return a Liability Release, a Publicity Release and any other documentation that Sponsor requires ("Guest Releases") within five (5) days after receipt by potential Grand Prize winner. Once submitted, Entries become the sole property of Sponsor and will not be returned. Notwithstanding anything to the contrary in Sponsor's privacy policy located at www.sonypictures.com/corp/privacy.html, except where prohibited by law, entry and/or a winner's acceptance of a prize constitutes permission of such winner for Sponsor to use, without notice or further compensation, worldwide, and in perpetuity, in any and all forms of media, now known and hereafter devised, including, without limitation, on the Web Site, such winner's first name, last initial, city and state. Additionally, if you choose to opt-in to a specific offer from a participating Sweepstakes Entity, your personal information will be subject to that Sweepstakes Entity's privacy policy and terms of service (if applicable) and you agree to receive additional email communication from that Sweepstakes Entity. Respective privacy policies of Sweepstakes Entities participating in opt-ins will be accessible from Sweepstakes home page. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of Sweepstakes or the Web Site or any Web page or Web banner ad related to Sweepstakes; to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any person attempting to defraud or in any way tamper with Sweepstakes will be ineligible to win a prize and will be prosecuted to the full extent of the law. If, for any reason, Sweepstakes is not capable of running as originally planned, Sponsor, at its sole discretion, reserves the right to cancel, suspend or modify Sweepstakes thereof and conduct the drawing from all eligible Entries received prior to and/or after (as appropriate) the action taken by Sponsor. In case of a dispute over the identity of an entrant who submitted a winning Entry, the owner of the email account associated with that Entry may be deemed the entrant. Said owner must comply with these Official Rules and, at Sponsor's sole discretion, may be required to provide proof of ownership of the email account.
   
   
6. Disclaimers: Sweepstakes Entities are not responsible or liable for Entries that are entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), or for Entries that are illegible, late, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged, incomplete, or otherwise not in compliance with these Official Rules and all such Entries will be disqualified. By entering Sweepstakes, each entrant agrees and acknowledges to be bound by the Rules and Laws, as well as the decisions of Sweepstakes Administrator which are final and binding in all respects; to waive any rights to claim ambiguity with the Rules and Laws, and that Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in Sweepstakes; use/misuse of a prize (including, but not limited to, cancellations and delays or any change by the air carrier(s), lodging facilities, or other company or any other persons providing any of the prize component for the Grand Prize winner and his/her guest due to reasons beyond Sponsor and/or Sweepstakes Entities control); human error; incorrect or inaccurate transcription of Entry Information; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or internet service provider utilized by Sweepstakes; interruption or inability to access Sweepstakes, Web Site, or any online service via the internet due to hardware or software compatibility problems; any damage to entrant's (or any third person's) computer and/or its contents related to or resulting from any part of Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, defects; and/or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities. Entrants further agree to indemnify and hold harmless Sweepstakes Entities from any and all liability resulting or arising from Sweepstakes, to release all rights to bring any claim, action or proceeding against Sweepstakes Entities, and hereby acknowledge that said Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize.
