  4. Prize/Odds of Winning: One (1) Grand Prize: One (1) Grand Prize will be awarded in this Sweepstakes. Grand Prize winner will receive a trip to San Diego, California for himself/herself and up to one guest (“Trip”). Trip consists of: roundtrip coach class air transportation for Grand Prize winner and guest from an airport near Grand Prize winner’s residence (as determined by Sponsor, in its sole discretion) to San Diego, CA; three (3) consecutive nights standard hotel accommodations (single room/double occupancy) at a San Diego area hotel; two (2) four day membership tickets to either the 2008 or 2009 Comic-Con International (at Grand Prize winner’s choice); and $300.00 spending money for the Grand Prize winner (which will be provided in the form of a check made out to winner). Approximate Retail Value “(ARV”) of Grand Prize: $3,250.00. Odds of winning the Grand Prize depend on the total number of eligible Sweepstakes Entries received during the Sweepstakes Period. The ARV of the travel component of the Trip may vary depending upon the point of departure, fare fluctuations, and hotel charges at the time of travel, and any difference in value will not be awarded. If Grand Prize winner is a resident of a jurisdiction that deems him/her to be a minor, Trip guest must be his/her parent or legal guardian. The travel guest must be eighteen (18) years of age or older and may not be deemed a minor in the jurisdiction that he/she resides, unless the travel guest is the child or a legal ward of the Grand Prize winner. If Grand Prize winner elects to travel or partake of any prize component alone, such affected prize component(s) will be awarded in increment(s) suitable for one traveler and no additional compensation will be awarded in conjunction therewith. Grand Prize winner and guest are solely responsible for obtaining all necessary and required travel documents. Air transportation will not be provided if Grand Prize winner lives within 100 miles of San Diego, CA and no additional or substitute compensation or ground transportation will be provided in lieu thereof. Grand Prize winner and/or his/her guest will be required to have/present at least one major credit card in good standing in order to check into hotel room, to cover any hotel incidentals (e.g., room service, phone calls) not specifically mentioned as being included. Trip is subject to air travel and hotel availability, holiday and black–out dates, and all other prize and travel restrictions. Grand Prize winner must take trip to attend his/her choice of either the 2008 or 2009 Comic-Con International or the Grand Prize will be forfeited in its entirety and no additional prize element will be substituted and an alternate Grand Prize winner may be selected in the sole discretion of Sponsor. Any costs associated with accepting, redeeming and/or using the Grand Prize which are not specifically mentioned herein as being included, are the sole responsibility of the winner including any ground transportation, any unspecified state or local taxes or government surcharges or fees, trip and travel insurance and premiums, excursions, meals, drinks, incidentals, gratuities, telephone calls, charges for changing dates or other personal costs and expenses not specified herein. Once determined, no extension or change of Trip dates permitted, except by Sponsor in its sole discretion and/or as otherwise permitted or contemplated in these Official Sweepstakes Rules. Once determined, the Sweepstakes Administrator will provide to the Grand Prize winner in an itinerary the specific dates, times and locations regarding the Trip and provide him/her with all other specific instructions. Grand Prize winner and his or her travel companion will be required to travel on identical itineraries including the same departure date, destination and return date. All airline tickets issued in conjunction with the Grand Prize are not eligible for frequent flyer miles or any other promotional benefit. No code-share flights, one-way trips or upgrades allowed. Grand Prize winner is solely responsible for any and all excess baggage charges, upgrades, taxes and any other charges incurred after or in connection with the issuance of airline tickets. Sponsor or its designee will not replace any lost or stolen tickets, travel vouchers or certificates or similar items once they are in the Grand Prize winner’s possession or in the possession of the Grand Prize winner’s travel companion. Any unclaimed and/or unused Grand Prize travel package or element of the Grand Prize will be forfeited by the Grand Prize winner and will remain the property of Sponsor. General entrance tickets are subject to Comic Con International operating schedule and policies. Terms and conditions subject to change without notice. No substitution, transfer, or cash equivalent for the Grand Prize, except that Sponsor, at its sole discretion, may substitute the Grand Prize with a prize of equal or greater value, whether due to the unavailability of Grand Prize or Grand Prize component, or for any other reason. Any depictions of Grand Prize are for illustrative purposes only. All federal, state, or other taxes (if applicable) including, without limitation, income taxes, are the sole responsibility of winner. Grand Prize winner will receive an IRS form 1099 from the Sweepstakes Administrator for the total ARV of the Grand Prize (stated herein) for the calendar year the Grand Prize was won.
  5. Drawing and Notification of Winners: Potential Grand Prize winner will be randomly selected from all eligible Sweepstakes Entries received in a drawing to be held by the Sweepstakes Administrator, an independent judging organization, on or about June 23, 2008 (“Drawing Date”). Potential Grand Prize winner will be notified by phone at the phone number provided on his/her Sweepstakes Entry within approximately two (2) weeks of the Drawing Date. If potential Grand Prize winner cannot be reached or no response is received from the potential Grand Prize winner within five (5) days of the date of notification or attempted notification, such potential Grand Prize winner will be disqualified, and an alternate potential Grand Prize winner may be selected (at Sponsor’s sole discretion) from all eligible Sweepstakes Entries received. Potential Grand Prize winner will be required to execute and return a notarized Affidavit of Eligibility/Release of Liability and (except where prohibited) Publicity Release form within ten (10) business days of the date of issuance of such documents. Potential Grand Prize winner’s travel companion is required to execute and return a notarized Release of Liability and (except where prohibited) Publicity Release form within this same ten (10) business day deadline. Where the potential Grand Prize winner or the travel companion is a minor in the jurisdiction where he/she resides, the parent or legal guardian must provide written consent on such forms. Potential Grand Prize winner’s failure to return all completed and required forms in this ten (10) business day time period may result in the potential Grand Prize winner being disqualified and an alternate Grand Prize winner may be selected at Sponsor’s sole discretion. If any delivery of the Affidavit of Eligibility/Release of Liability and Publicity Release forms or Grand Prize is returned as undeliverable for any reason, the potential Grand Prize winner shall be disqualified and Sponsor may decide, at its sole discretion, to award the Grand Prize to an alternate Grand Prize winner selected from the remaining eligible Sweepstakes Entries. If Grand Prize winner is a resident of a jurisdiction that deems him/her to be a minor, his/her Grand Prize will be awarded in the name of his/her parent/legal guardian. Grand Prize and Grand Prize notifications/documents will be mailed/shipped to street addresses located within the 50 states of the U.S. or D.C. only.
  6. General Conditions: This Sweepstakes is subject to these Official Rules and all federal, state and local laws and regulations (collectively “Rules and Laws”). Once submitted, Sweepstakes Entries will not be acknowledged or returned. Except where prohibited by law, winner’s entry and/or acceptance of the Grand Prize constitutes permission of winner (or, if a resident of a jurisdiction that deems him/her to be a minor, his/her parent or legal guardian) for Sweepstakes Entities to use, without notice or further compensation, worldwide, and in perpetuity, in any and all forms of media, now known and hereafter devised, such winner’s name, likeness, pictures, photographs, voice, biographical information and statements, for purposes of advertising, trade, promotion and publicity. Additionally, if an entrant chooses to opt-in to receive communications from any of the Sweepstakes Entities, his/her personal information will be subject to that Sweepstakes Entity’s privacy policy and such entrant agrees to receive additional email communication from that particular Sweepstakes Entity. Opting-in to receive communications does not improve one’s chances of winning the Grand Prize. Sponsor reserves the right, in its sole discretion, to disqualify any individual it (or its authorized designee hosting the Website) finds to be: (i) tampering with, as applicable, the entry process or otherwise with the operation of the Sweepstakes (including, but not limited to, the use of automated computer programs or any non-human mechanism, entity, or device), the Website, or any Web page or Web banner ad related to the Sweepstakes; (ii) acting in violation of the Official Rules; (iii) acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, harass, harm, mislead, or defraud any other individual or entity; or (iv) otherwise in violation of law. Any person attempting to defraud any of the Sweepstakes Entities or in any way tamper with the Sweepstakes will be ineligible to win the Grand Prize and Sponsor will seek all remedies available to it, including, if appropriate, filing appropriate complaints with legal authorities. If, for any reason, the Sweepstakes or the Website (or any portion thereof) becomes corrupted, or is not capable of running as originally planned, or does not allow the proper playing of the Sweepstakes and processing of Sweepstakes Entries in accordance with these Official Rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor’s sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Sweepstakes or the granting of the Grand Prize or any component thereof, Sponsor reserves the right, in its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend the Sweepstakes or any portion thereof and to conduct the drawing and award the Grand Prize from all eligible, salvageable Sweepstakes Entries received (if any), prior to and/or after (as appropriate) the action taken by Sponsor or otherwise in a manner that is fair and equitable as determined by Sponsor. In the event that Sponsor determines that there are no eligible entrants, Sponsor reserves the right in its sole discretion to not award the Grand Prize (or any portion thereof). In case of a dispute over the identity of an entrant who submitted a winning Sweepstakes Entry, at Sponsor’s sole discretion, the authorized account holder of the email address associated with that entry will be deemed the entrant. The "authorized account holder" is deemed the natural person who is assigned to an email address by an Internet access provider, service provider or other on-line organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Said owner must comply with these Official Rules and, at Sponsor’s sole discretion, may be required to provide proof of ownership of the email account.
  7. Limitation of Liability: Sweepstakes Entities are not responsible or liable for Entry Information that is entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), in excess of the stated entry limit, or for Entry Information that is illegible, late, forged, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged, garbled, altered or otherwise not in compliance with these Official Rules, whether caused by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error which may occur in the processing of Entry Information in the Sweepstakes, or for failure to receive Entry Information due to transmission failures or technical failures of any kind and such Entry Information will be disqualified.
